Epic Hosting, LLC - Terms and Conditions
Welcome to Epic Hosting, LLC (“Epic Hosting,” “we,” “us,” or “our”). By purchasing or using our services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.
1. Services
Epic Hosting provides virtual machines (VMs) through a hybrid setup that includes on-premises servers at our company headquarters and cloud-based infrastructure through DigitalOcean. We offer both unmanaged and managed hosting services, subject to these Terms and Conditions.
2. Account and Responsibilities
- Account Creation: You must provide accurate and complete information when creating an account. It is your responsibility to keep your account credentials secure.
- Usage: You are responsible for any activity that occurs under your account. You agree to use our services only for lawful purposes and in compliance with all applicable laws and regulations.
3. Billing and Payment
- Payment Terms: All services are prepaid. Payment is due at the time of purchase and at the beginning of each billing cycle.
- Currency: All payments must be made in U.S. Dollars.
- Late Payments: Accounts with overdue balances may be suspended or terminated.
- Refund Policy: Refunds are provided at our sole discretion and are not guaranteed.
4. Service Availability and Performance
- Uptime Guarantee: Epic Hosting strives for 99.9% uptime but cannot guarantee uninterrupted or error-free service. Downtime due to scheduled maintenance or events beyond our control does not count toward the uptime guarantee.
- Hybrid Setup: VMs may be hosted on-premises or on DigitalOcean infrastructure. While we endeavor to ensure consistent performance across both environments, certain features and performance metrics may vary.
5. Data and Security
- Backups: You are responsible for maintaining backups of your data. While Epic Hosting offers optional backup services, we are not liable for data loss.
- Security: We implement industry-standard measures to protect your data, but we cannot guarantee absolute security. You are responsible for securing your account and applications.
6. Acceptable Use Policy
You agree not to:
- Use our services for illegal or harmful activities, including but not limited to hosting malware, engaging in fraudulent activities, or violating intellectual property rights.
- Engage in activities that disrupt or degrade the performance of our services for other customers.
- Host or distribute prohibited content, including but not limited to explicit, violent, or hateful material.
7. Managed Support (if applicable)
- Scope of Support: Managed support includes assistance with setup, troubleshooting, and routine maintenance. It does not include custom development or application-specific support.
- Additional Fees: Managed support is subject to additional fees, as outlined in your service plan.
8. Liability and Indemnification
- Limited Liability: To the maximum extent permitted by law, Epic Hosting is not liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
- Indemnification: You agree to indemnify and hold Epic Hosting harmless from any claims, damages, or expenses arising from your use of our services.
9. Termination
- By Customer: You may terminate your account at any time. Prepaid fees are non-refundable.
- By Epic Hosting: We may suspend or terminate your account for violation of these Terms and Conditions or if required by law.
- Effect of Termination: Upon termination, your access to services will cease, and any data stored with us may be permanently deleted.
10. Amendments
Epic Hosting reserves the right to update these Terms and Conditions at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the revised terms.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict of laws principles.
